Following a written inquiry towards our Authority, regarding the potential inclusion to the provisions of Article 20B L.4251/14 upon issuing an Investor Permanent Residence Permit for a third country citizen who acquired ownership on real estate property following the legal procedure of auction, the Council of State, pursuant to the Opinion N. 153/2020 (D’ Section, available on the Council of State website), which was accepted by the Minister of Immigration and Asylum, on 22/12/2020, approved the following:
“Following the auction of a property, situated within Greece, and the deposit of the total auction proceeds, set at the minimum amount of 250.000 euro, by the highest bidder, third-country citizen, to the auction employee, the issuance of an Investor Residence Permit is possible according to the provisions of Article 20B L.4251/14, as currently in force, under the following strict conditions: a) the deposit of the auction proceeds to the auction employee shall be conducted in one of the ways restrictively listed within the provisions of article 20B case 2 L. 4251/2014, as currently in force, b) the transcription of the Allocation Report Summary to the competent Transcript records shall be completed and c) the auction shall not be annulled via any of the predicted legal ways”.
Following the above, we are notifying you that all arising relevant cases shall be examined under the scope of the above Opinion.
